School Tree Growing Campaign in Kenya

Terms and conditions of the draw promotion to be carried out by the commercial entity The Chaingers Union, S.L.

The company THE CHAINGERS UNION S.L (hereinafter, ‘CHAINGERS’ or the ‘Organisation’), with CIF numberB72583016 and registered office and for notification purposes at Calle Iradier, 19-21, 08017, Barcelona, is organising the following promotional action called SWEEPDRAW (hereinafter, ‘the Promotion’ or the ‘Draw’) with the aim of promoting the action ‘School Tree Planting in Kenya’ (hereinafter, ‘Kenya’), promoted by the HUMANSDID community, which will be governed in accordance with the requirements stipulated in these legal bases (hereinafter, the ‘Bases’).

All participants in the Promotion, by the simple fact of their participation, accept the Bases and the rules governing its procedure.

The Promotion shall be valid anywhere in the world, with the application of Spanish laws and their corresponding compliance with the legislation of other countries.

The period for entering the Prize Draw will begin on 4 March 2025 and end on 16 March 2025 inclusive (the ‘Promotional Period’).

The Draw will take place on 21 March 2025 and the winner will be announced on 26 March 2025.

The Organiser reserves the right to change the dates on which the Promotion may be entered at any time and may cancel the Promotion early or extend the Promotion.

All natural persons over sixteen (16) years of age, inclusive (hereinafter, the ‘Participants’) may participate in the draw. In the event that the Participant is between sixteen (16) and eighteen (18) years of age, his/her participation will be conditional upon the prior express authorisation of his/her legal representatives or guardians.

The Organisation reserves the right to verify the age of the Participants prior to the celebration of the draw and to require the necessary documentation to accredit compliance with this requirement.

Partners, employees of the organising company, CHAINGERS, and their direct relatives up to the second degree of consanguinity or affinity are not eligible to participate in the draw.

Likewise, in order to participate, they must comply with the requirements established in these Legal Bases.

The Organisation reserves the right to exclude those Participants who do not comply with the requirements established in these Rules, who are misusing it or impeding the normal development of the Draw, or who carry out fraudulent acts that contravene transparency and/or harm other Participants, as well as any participation that damages or may damage the image of the Organisation.

In these cases, the Organisation reserves the right to take any legal action that may correspond to it and in no case will assume any responsibility towards those Participants whose participation has been excluded.

Participation in the prize draw is free of charge.

This promotion will be communicated through the website humansdid.com as well as through other digital media of HUMANSDID, such as its newsletter and @_HUMANSDID accounts on Instagram, LinkedIn and TikTok.

The first prize of this promotion consists of a trip to Kenya for two people to participate in the planting of trees in one of the schools included in the ‘Kenya’ programme. This trip includes return economy class flights for two people, airport pick-up, transfers to the hotel and to the school where the tree planting will take place and accommodation expenses for three nights in a double room in a three or four star hotel, including breakfast.

The default point of departure for air travel to Kenya will be Spain. Another point of departure may be considered as long as the total cost of the trip for two persons (flights, transfers and hotel) does not exceed €2,500. In the event that the cost of the trip exceeds this amount, the Winner and his/her companion will be responsible for the travel expenses to a departure point that meets the requirements set out in the Rules.

The prize does not include any expense or concept not expressly detailed in these Rules, and any additional expenses must be assumed by the Winner and, if applicable, by his/her companion.

The trip must take place between April and June 2025, the period when the trees are planted in the schools.

The second prize will be for the next three winners in the draw and will consist of being able to speak directly with Mary Manana, head of the non-governmental organisation Nature Lovers in Kenya, and Markus Foster, head of the organisation Tree Sixty, partners of the Kenya project. This will be done through online media (Zoom or Google Meet) during the month of May (on a date that will be communicated through HUMANSDID’s own media and directly to the winners). In no case the winner of the first prize will be able to participate.

The prizes awarded in the prize draw may under no circumstances be subject to change, alteration or compensation at the request of the winner, without being able to use their cash value.

The prizes awarded in the prize draw may not be exchanged for their cash value, nor may they be subject to change, alteration or compensation at the winner’s request.

The Organisers reserve the right to change the prize to one of equal or greater value than indicated in the Rules, in the event that the initial prizes offered cannot be awarded for reasons beyond their control.

The Organisation is exempt from any obligation or compensation to the Participants, if for reasons of force majeure or legal imperative the present Draw should be cancelled or suspended, a situation that will be duly notified to the Participants.

The winner and companion of the prize that is the object of the Draw, upon acceptance of the prize, authorise the Organisation to use their name and image in all activities related to the Prize, for advertising or publicity purposes, without them being entitled to receive any payment or consideration for this.

In the event that the prize includes a companion, the companion must expressly authorise the Organisation to use his/her name and image in all activities related to the prize, for advertising or publicity purposes, without this giving rise to any right to financial or any other type of compensation.

To participate in the draw and be eligible for the prize described in point 5 of these Terms and Conditions, Participants must:

  1. Be registered on the HUMANSDID website. The registration must include name, surname and email address.
  2. Have participated in the voting process on whether or not to accept the ‘Kenya’ project submitted by HUMANSDID to its community of registered members.

The above requirements must be fulfilled prior to the date of the draw.

In any case, those participation applications that are submitted outside the Promotional Period – point 3 – or those that do not complete, totally and integrally, the requested data, and those that contain false or erroneous data, will be rejected and will not be considered valid and will be excluded from the draw.

The draw will take place on 21 March 2025, and the winner will be announced on 26 March 2025.

The Organisation will draw up a list of all the participants in the draw and will send it to https://app-sorteos.com/es/apps/sorteados. This will be done by exporting the Participants‘ e-mails from the HUMANSDID community members’ registration database.

Once this field is completed, we will click on the ‘Start’ button. Then we will configure the draw on the page itself. We will indicate that there must be only one winner and as substitutes we will choose four more names.

In addition, the draw will be completed by selecting three names as second prize winners and twelve reserves. 

After a countdown, the winner of the competition and the winners of the 2nd prize will appear in the app-draws application.

Both first and second prize winners as well as the respective reserves will be determined by a single draw.

The Organisation will contact the Winners through the contact details provided when completing the participation application form, to inform them that they have won the Prize Draw and of the prize that has been awarded to them.

The Winners may be asked to provide the Organisation with the necessary documentation to prove their identity and that they coincide with the person who has won the prize.

If any of the Winners is a minor, he/she must provide the details of the legal representative or guardian as soon as possible. In the event that, with two weeks remaining until the previously agreed start date of the trip, the details of the guardian or legal representative have not been accredited, the Winner will lose the prize and the Organisation will proceed to designate the person who appears as an alternate in the Minutes of the draw.

Once the Organisation notifies the Winners of the prize, they will have a period of ten (10) calendar days to accept the prize. In the event of not receiving confirmation within the aforementioned period, the prize will be assigned to the Substitute who appears as such in the minutes of the draw. The alternate will have the same period of time to confirm acceptance of the prize.

In the event that, once the process of replacing the Winner with an Alternate is completed, the prize remains vacant, the Organisation reserves the right to select a new alternate or dispose of the prize as it deems appropriate.

All the personal details of the Participants provided to the Organisation, where applicable, within the framework of the Prize Draw must be truthful and up to date, and the Winner or Substitute undertakes to notify the Organisation of any modification of the same.

The non-receipt by the Participant of the messages sent to the means of contact provided, whatever the cause, will exempt the Organisers from any responsibility in this respect, and the Organisers are under no obligation to use alternative means of notification.

CHAINGERS complies with current data protection regulations and, in particular, with the European General Data Protection Regulation (‘GDPR’) and with Organic Law 3/2018, of 5 December, on Personal Data Protection and guarantee of digital rights (‘LOPDDGG’).

By participating in this Sweepdraw, all Participants have been informed that CHAINGERS will process the personal data of the Participants and that these data will be confidentially incorporated into a file for which the Organisation is responsible.

CHAINGERS will use such personal data in accordance with the purpose for which they were requested, i.e. for the holding of the Sweepdraw, maintaining levels of security in the protection of such data in accordance with the laws in force. Personal data obtained specifically in connection with the Sweepdraw will cease to be processed once the Sweepdraw has ended. However, data collected in connection with registration as a member of the HUMANSDID community will continue to be processed by CHAINGERS in accordance with its applicable privacy policy. In any case, the data, including the specific data obtained to hold the Sweepdraw, will be retained, even after the relationship with the Participants has ended, only as long as they are necessary to respond to possible liabilities or in compliance with legal obligations.

Under no circumstances will this file be transferred or sold to other companies without the prior and explicit permission of the user.

For any query, request or clarification regarding the processing of personal data of the participants, they may send their requests to the following e-mail and postal address info@humansdid.com with the reference ‘Data Protection’.

Likewise, participants may exercise their rights of access, rectification, deletion, limitation of processing, portability and opposition by sending a request by e-mail or post to dpo@teamlabs.es, with the reference ‘ARCO-POL rights’. If participants consider that their rights have not been respected, they may lodge a complaint with the Spanish Data Protection Agency, through its electronic headquarters (www.aepd.es) or via its postal address.

The prize for two people (flights, transfers and hotel) will have a maximum total value of €2,500.

The prizes of this draw are subject to taxation and, therefore, Law 35/2006, of 28 November, on Personal Income Tax and partial modification of the laws on Corporate Income Tax, Non-Residents’ Income Tax and Wealth Tax will be applicable. The prize-winner must include in his/her taxable base for Personal Income Tax, the value of the gift obtained plus the deposit on account, if any. CHAINGERS will issue, in the event that it is obliged to do so by the applicable regulations, the mandatory certificate where these concepts will appear.

The period for claiming the prize will end twenty (20) calendar days after the day on which the draw is held.

Participation in the draw implies the acceptance of these rules, as well as the express submission to the interpretative decisions made by the Organisation.

These rules will be published on the website humansdid.com in the section of the Kenya project.

The Organisation is exempt from any type of responsibility from the moment the Prize is awarded to the Winner and during the enjoyment of the same.

Under no circumstances may any legal action be taken against the Organisation for any reason arising from the misuse or enjoyment of the Prize.

These terms and conditions are governed by the Spanish common law in force.

Any claim related to the Promotion must be sent in writing to CHAINGERS, at its registered address. In the event of any dispute in the application or interpretation of these Rules and in the absence of an amicable agreement, the Participants expressly submit to the Jurisdiction of the Courts and Tribunals of the city of Barcelona.
